To the extent liability cannot be excluded, our total liability for any claim arising out of or relating to these Terms, the website, or the Services will be limited to the greater of: (a) the amount you paid to Pimugo B.V. for Services in the 12 months prior to the event giving rise to the claim, or (b) €100.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for intent (opzet) or willful misconduct, or other non-excludable statutory liability.
11. Indemnification
You agree to indemnify, defend, and hold harmless Pimugo B.V. from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the website or Services, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.
